By accessing or using our services, you agree to comply with these Terms of Use. If you do not agree with these terms, please refrain from using our services.
MediScan AI provides automated tools and technologies designed to assist healthcare professionals in generating medical record summaries and related documents. These tools are intended to streamline workflows and enhance efficiency in medical documentation processes.
While MediScan AI may provide assistance in generating medical record summaries and other related documents, it is important to acknowledge that healthcare professionals, including doctors and other professionals in the Med/Legal space, retain the primary responsibility for:
Healthcare professionals should exercise independent judgment and critical thinking when using the Services provided by MediScan AI. While the Services may assist in organizing and summarizing medical information, they should not replace or diminish the role of healthcare professionals in making informed decisions about patient care.
It is important for healthcare professionals to recognize that the Services provided by MediScan AI have limitations and are not intended to serve as a substitute for professional medical judgment or expertise. Users should always review and validate the information provided by the Services in the context of their clinical knowledge and experience.
AI-Generated Outputs
The MediScan AI Platform generates summaries, chronologies, reports, and other outputs using machine learning models. These outputs may contain inaccuracies, omissions, or other errors. All outputs are provided for informational purposes only and are not intended to replace the professional judgment of qualified healthcare providers or legal professionals. Users remain solely responsible for reviewing, verifying, and determining the appropriateness of all outputs prior to reliance or use.
No Medical or Legal Advice
MediScan AI does not provide medical, legal, or professional advice. The Platform is an assistive tool intended to support—but not replace—professional expertise. Decisions made in reliance on the Platform are made at the user’s own risk.
Disclaimer of Warranties
The Platform and all outputs are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability
To the maximum extent permitted by law, MediScan AI’s total liability for any claim arising out of or relating to the use of the Platform shall not exceed the total fees paid by the user to MediScan AI during the twelve (12) months immediately preceding the event giving rise to such liability. In no event shall MediScan AI be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, loss of data, or business interruption.
Assumption of Risk & Waiver
By using the Platform, users acknowledge and accept the inherent limitations of AI-generated outputs and agree that MediScan AI shall not be held liable for reliance upon such outputs without independent professional review. Users expressly waive any claims against MediScan AI arising from such reliance.
Indemnification
Users agree to indemnify, defend, and hold harmless MediScan AI and its officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from or related to: (a) the user’s reliance on AI-generated outputs without proper verification; or (b) the user’s violation of applicable laws, regulations, or third-party rights.
Healthcare professionals are encouraged to collaborate with other members of the healthcare team and consult with specialists or colleagues as needed to ensure comprehensive and effective patient care. While the Services provided by MediScan AI may facilitate communication and collaboration, they should not replace direct communication or consultation when necessary.
Users of the Services provided by MediScan AI are expected to comply with all applicable legal and ethical standards governing the practice of medicine, including patient confidentiality, informed consent, and professional conduct.
All content and materials provided through the Services, including but not limited to software, algorithms, text, graphics, images, and logos, are the property of MediScan AI or its licensors and are protected by intellectual property laws. Users may not use, reproduce, or distribute any content from the Services without prior written permission from MediScan AI.
Your use of the Services is also governed by our Privacy Policy, which outlines how we collect, use, share, and protect your information. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy.
Data Retention
MediScan AI retains uploaded records, summaries, and other associated content for the duration of your active account. Our platform supports long-term record storage and meets HIPAA and SOC 2 standards for data security and availability.
Unless required by law or regulation, MediScan AI will not delete any records unless:
Account deletion requests may take up to 30 days to process. Upon account deletion, MediScan AI will retain your records for up to 60 days to allow for data export or reactivation, after which all data will be permanently deleted unless otherwise required by law. If you wish to delete specific records or all records associated with your account, you must request deletion through your account dashboard or by contacting support@mediscan.ai.
While MediScan provides secure infrastructure for record storage, users are ultimately responsible for exporting and backing up any records they wish to retain outside the platform. MediScan’s data retention and deletion procedures are governed by our internal Data Management Policy and comply with industry best practices for protected health information (PHI) and sensitive legal data.
Service Level Agreement
1. Uptime Commitment
MediScan AI will use commercially reasonable efforts to maintain at least 99.5% uptime each calendar month. This allows for up to 3.5 hours of unplanned downtime per month.

We provide email-based support during business hours (9am–5pm PT, Monday–Friday).

If uptime drops below 99.5% in a given month and you are a paying customer, you may request a pro-rated service credit for the downtime. This is your sole and exclusive remedy for breach of this SLA.
5. Changes to this SLA
MediScan AI may update this SLA from time to time. Material changes will be communicated in advance through email or in-app notice.
MediScan AI reserves the right to suspend or terminate your access to the Services at any time and for any reason, including but not limited to violation of these Terms of Use or applicable laws and regulations.
We do not knowingly collect personal information from children under the age of 13 without verifiable parental consent. If you believe that we have inadvertently collected information from a child without proper consent, please contact us immediately.
MediScan AI may update or modify these Terms of Use at any time without prior notice. Users are responsible for regularly reviewing the Terms of Use to stay informed of any changes. Continued use of the Services after changes to the Terms of Use constitutes acceptance of the revised terms.
